Terms and conditions

These terms apply to all treatment agreements between Cuveele's Clinic—legally reffered to as Dr. Louise Cuveele BV—and clients, executed by associated or freelance medical and aesthetic consultants, as long as the activities are within the clinic's scope. The terms are always available upon request and can be sent to clients free of charge.

Definitions

  • Dr. Louise Cuveele BV (BE 0803.189.197): Practice for aesthetic treatments and/or the independent medical practitioners working there.

  • Cuveele's Clinic: The commercial name of Dr. Louise Cuveele BV.

  • Treatment agreement: Any agreement between Dr. Louise Cuveele BV and a client concerning a treatment.

  • Client: The counterparty of Dr. Louise Cuveele BV when entering into an agreement.

  • Treatment: All medical and aesthetic treatments performed at Dr. Louise Cuveele BV.

  • Website: The website of Dr. Louise Cuveele BV, www.cuveelesclinic.com.

  • Personal data: Data related to the client including name, address, telephone number, email address, sex, date of birth and language.

  • Medical data: Medical information about the client required to perform the treatment. Medical data is provided by the client itself or stored by Dr. Louise Cuveele BV during appointment.

  • Digital identifiers: Data related to the client's online presence on the website such as IP-address, operating system, device settings, time of website visit, visited website pages.

Deviations

Deviations from these terms are only valid if explicitly agreed upon in writing by Dr. Louise Cuveele BV. The client waives the applicability of their general terms.

Commitment of effort

All treatments performed by medical practitioners are classified as medical treatments. The doctor has an obligation of effort, not an obligation of result. Aesthetic consultants, employees, and managers are obligated to perform treatments to the best of their knowledge and ability, without guaranteeing specific results.

Dr. Louise Cuveele BV will execute the treatment agreement to the best of its knowledge and ability, following good craftsmanship standards. Dr. Louise Cuveele BV has the right to outsource specific tasks to third parties if necessary for proper execution. Client consent is not required.

Confidentiality

Dr. Louise Cuveele BV maintains confidentiality about medical data towards third parties not involved in the execution of the assignment. This duty of confidentiality does not apply if the law requires disclosure of certain information. Dr. Louise Cuveele BV may use medical data for statistical or presentation purposes, ensuring it is not traceable to the individual client. Personal data and digital identifiers can be used for analyzing website page visits and clicking behavior.

Loss or damage of clients' property

Dr. Louise Cuveele BV is not liable for damage to or loss of clients' property. Clients must take care to prevent damage or loss of their belongings.

Prepayment, cancellation and no-show policy

Appointments must be prepaid by the client if requested by Dr. Louise Cuveele BV; otherwise, payment is due after the treatment. If a consultation or treatment appointment is canceled 12 hours or less in advance, or when the client does not show up at the time of the appointment (no-show), a minimum administrative fee of €50 will be charged. Additional costs may be charged, but clients will be informed in advance.

Force majeure

Circumstances not attributable to Dr. Louise Cuveele BV preventing task execution include unforeseeable personnel shortages, a general lack of necessary materials or services, unforeseeable supplier delays, transportation issues, or flight changes. These circumstances are considered force majeure if they make task execution impossible or unreasonably difficult. If such circumstances occur after Dr. Louise Cuveele BV should have fulfilled its obligations, the clinic still has the right to invoke force majeure. During force majeure, Dr. Louise Cuveele BV's obligations are suspended. If the period exceeds three months, both parties have the right to terminate the agreement without compensation. If Dr. Louise Cuveele BV has partially fulfilled its obligations before force majeure, it can invoice the fulfilled part separately.

Client identification

Clients must provide the necessary information and cooperation for the treatment agreement execution to the best of their knowledge. This includes showing identification if requested. Clients must always be able to identify themselves with a legally recognized ID at Dr. Louise Cuveele BV's request. If a client cannot show ID upon request, Dr. Louise Cuveele BV can suspend the treatment agreement.

Improper or disrespectful behaviour

Termination or suspension of the treatment agreement is possible if the client behaves improperly or disrespectfully towards Dr. Louise Cuveele BV, its employees, volunteers, or fellow clients.

Liability

Dr. Louise Cuveele BV's liability for direct or consequential damage, to the extent covered by its liability insurance, is limited to the insurance payout. If the insurer does not compensate or the damage is not covered, Dr. Louise Cuveele's liability is limited to the invoice amount. Claims for liability compensation expire one year after the damage-causing event.

Dr. Louise Cuveele BV is not liable for damage covered by insurance (e.g., travel or cancellation insurance, health insurance), nor for damage suffered by clients in their professional or business activities (including missed workdays or delayed arrival at the workplace).

Complaints

Complaints about work or invoices must be reported in writing within 30 days of discovery, but no later than three months after work completion. A complaint does not suspend the client's payment obligation. If a complaint is justified and rectification is possible, Dr. Louise Cuveele BV will perform the agreed-upon work.

Belgian law

Belgian law applies to all agreements between clients and Dr. Louise Cuveele BV. Disputes related to the agreement are settled by the competent court in the district where Dr. Louise Cuveele BV operates.

We value your privacy and aim to inform you in this policy how we collect, maintain, and process your data. All data collected is processed within Belgium under European legislation, ensuring your privacy is protected.

What data do we collect?

  • Google Analytics: Google Analytics is a web analytics service offered by Google that tracks and reports website traffic. Google uses the data collected to track and monitor the use of our Service. This data is shared with other Google services.   • Forms: We collect your name, first name, email address, phone number, IP address, date/time, preferred language, birth date and postal code via web forms to contact you and respond to inquiries. Data is stored in a database and can be accessed, modified, or deleted upon request.

  • User experience: Essential cookies are used for optimal navigation and browsing experience. Detailed cookie lists can be found in your web browser, where you can choose which to disable.

User rights

You have the following rights:

  • Access your data and its processing

  • Modify your data

  • Be forgotten and have data deleted from databases

  • Withdraw consent

  • Temporarily halt data processing

  • Data portability to another controller

  • Disable automatic profiling

You can file a complaint with the Privacy Commission if you believe your data is collected and processed unlawfully. Complaints can be filed via the Data Protection Authority's website.
